Terms of Service

These Terms govern the agreement between Relaytera and each customer that creates, joins, or uses a Relaytera workspace or a separately ordered managed service.

1. Agreement and authority

By creating an account, accepting an invitation, or using Relaytera, you agree to these Terms and confirm that you have authority to bind the customer you represent. Relaytera is the service provider under these Terms.

If you do not agree, do not create an account or use the service. Workspace owners are responsible for users they invite and for keeping account and billing information accurate.

2. The service

Relay is an outbound application-email service. It provides API and authenticated SMTP submission, sender-domain verification, delivery tooling, templates, audiences, events, diagnostics, and related controls. Native inbound receiving is not a generally available Relay product unless Relaytera expressly makes it available in writing for the relevant account.

Relay Hosting (cPanel), where ordered, is a separate managed hosting and mailbox subscription for a customer-controlled domain. It has its own account, storage allowance, DNS setup, service credentials, billing record, and retention lifecycle. Relaytera does not register, transfer, or renew a customer domain.

Relay Mail is a separate branded-mailbox service. Webmail, IMAP, JMAP, authenticated SMTP, aliases, and shared-inbox capabilities are only available where Relaytera has expressly enabled that service for the customer after its service-specific onboarding and safety controls are satisfied. It is not bundled into Relay or Relay Hosting unless an order says so.

Relaytera can report acceptance, handoff, and provider feedback where those signals are available. It cannot guarantee inbox placement, delivery time, reception, or acceptance by a recipient network; those outcomes remain controlled by recipient providers and the customer’s sender practices.

3. Customer responsibilities

  • Use only domains, sender identities, recipient data, content, and credentials you are authorised to use.
  • Maintain documented recipient permission and honour opt-outs, complaints, privacy rights, and applicable marketing rules.
  • Protect API keys, SMTP credentials, administrator accounts, and integration tokens; promptly rotate anything exposed.
  • Keep sending configurations accurate and comply with the Acceptable Use Policy.
  • For Relay Hosting, retain control of the primary domain and choose either the supplied nameservers or the account-specific manual DNS records. For Relay Mail, publish only the mailbox DNS records shown in Mail hosting. Do not replace a valid SPF, DKIM, or DMARC policy without resolving the conflict first.

4. Fees, plans, and taxes

Paid services, usage limits, billing intervals, renewal, and any overage treatment are shown before checkout or in an order. Relay, Relay Hosting, and Relay Mail are separate subscriptions unless an order expressly combines them. Fees are due in the stated currency. Tax treatment is displayed at checkout when public paid sales are enabled.

Billing, cancellation, consumer information, and refund handling are described in the Billing & Cancellation Policy. Statutory rights are not limited by these Terms.

5. Suspension and termination

Relaytera may throttle, pause, or suspend sending or Relay Hosting access to protect recipients, the platform, or shared reputation; investigate suspected abuse or compromise; comply with law; or address overdue payment. Where practical, notice and a path to review will be provided.

Either party may terminate as allowed by its plan or order. After termination, access ends and data is handled under the Privacy Policy, DPA, the product-specific retention/deletion process, and applicable law. Terms that by nature should survive termination continue to apply.

6. Intellectual property and feedback

Customers retain rights in their content and data. They grant Relaytera the limited rights needed to host, process, transmit, secure, and support that material. Relaytera and its licensors retain rights in the service, software, documentation, and branding.

Feedback may be used to improve Relay without restriction or payment, provided it does not identify customer confidential information.

7. Confidentiality, warranties, and liability

Each party must protect the other party’s non-public confidential information using reasonable care and use it only for the agreement. Required disclosures are permitted when legally compelled and, where lawful, notified in advance.

Except for express commitments in an order and rights that cannot lawfully be excluded, the service is provided as available. Liability exclusions, caps, indemnities, and any service levels must be settled in the customer’s applicable order and governing law; this public policy does not override mandatory legal rights.

8. Changes, law, and contact

Material changes will be posted with a new effective date and version. These Terms are governed by the laws of the State of California, USA, subject to mandatory rights and any different written order. Legal notices may be sent to support@relaytera.com or 201 STANTON ST PASADENA CA 91103-1454 USA.
